The Jobsite ConcreteGuarantee™
If we make a mistake and it costs you a fine, we refund what you’ve paid us. Here are the terms, in full, with nothing held back for the fine print.
What we guarantee
If you incur a fine or penalty from FMCSA, CHP, CARB or DMV, and that fine is directly caused by our error or omission in performing a service listed in your service agreement, we refund your service fees under the terms below.
“Error or omission” means we failed to perform a service you’re paying us for, or failed to perform it as the agreement describes. It does not mean the outcome of an audit, inspection or review. No provider can guarantee you will pass one, and we don’t.
What we refund
The lesser of the fees you paid us in the twelve months before the violation (or, for a period, before the violation period start), or $10,000.
This is a one-time, lifetime limit per client. It is not per fine and not per year. Once we pay a claim, the guarantee is used up for your account and does not renew, however long you stay with us. Service continues; coverage does not.
It is our sole remedy for the covered event.
We do not pay the fine itself. Federal law keeps that responsibility with you as the employer, and no agreement can move it.
What we don’t cover
- Any requirement that isn’t in your service agreement.
- Fines caused by information you gave us late, incompletely or inaccurately.
- Fines caused by your not responding to our request for records, signatures or approvals. We request in writing, follow up on a set schedule, and tell you in writing when a requirement is at risk. If we’ve done that and the item doesn’t reach us, the guarantee doesn’t apply.
- Decisions the regulations reserve to you as the employer: removing a driver from safety-sensitive duty, designating your DER, and reasonable suspicion, post-accident, return-to-duty and follow-up testing decisions. We advise; the decision is yours.
- Vehicle defects, driver conduct, hours of service, accidents, and any roadside violation not caused by a records failure on our part.
- Anything from before your service started, including gaps we identified in your review that you chose not to remediate.
- Knowing or willful non-compliance.
Your side of it
Your account is active and paid current, you respond to our written requests within the timeframes we state, and you follow our written instructions for the service in question.
How to claim
Send us the complete agency notice within 30 days of the date printed on it. We respond within 15 business days with our determination and, where the guarantee applies, the refund.
If the agency later reduces or cancels the penalty, any amount we refunded comes back to us.
Accepting a refund
We pay on a signed release of all claims arising from that event.
What this isn’t
This is a contractual refund, not insurance and not an indemnity. It doesn’t transfer your legal responsibility for compliance, and nothing here creates a duty beyond the services in your agreement.
